A practical guide to the parts of the Mental Health Act 1983 that clinicians need in their daily practice and relevant parts of other related legislation. Covers the 2007 amendments to the Act plus changes resulting from the new Social Care Act 2012. It gives advice on detaining & treating patients and giving evidence to mental health tribunals.

This is a 'how to' book guiding clinicians through the mental health legislation that they need to understand and use in their daily practice. It includes practical advice on detaining and treating patients, civil and court detentions, community treatment orders, consent to treatment and giving written and oral evidence for Mental Health Tribunals. In addition to the Mental Health Act 1983 and its more recent amendments from 2007, the book also covers relevant aspects of the Human Rights Act 1998, the Mental Capacity Act 2005 (including the Deprivation of Liberty Safeguards) and illustrative case law. This new edition takes into account changes brought about by the new Health and Social Care Act 2012. It includes the new form for consenting community treatment order patients and significant new case law that has a bearing on clinical decision-making. Tony Zigmond is a psychiatrist with many years experience of using the legislation in his clinical practice.
The book is written using the language of clinicians and includes practical answers to many of the questions regularly asked of the author during the many training courses for section 12 approval and Approved Clinician training that he has given.
